Terms of Service — earn²keep

1. Acceptance of Terms

By accessing or using earn²keep (the “Service”), provided by earn²keep (“earn²keep,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization (school, team, church, scout troop, gym, club, nonprofit, etc.), you represent that you have authority to bind that organization to these Terms.

2. Eligibility & Accounts

You must be at least 18 years old to create an Organizer account. Users under 18 may participate as Participants only with explicit consent and oversight from a parent, guardian, or authorized organization leader. Users under 13 are subject to additional protections — see our Children's Privacy Notice.

You are responsible for safeguarding your account credentials. earn²keep is not liable for losses caused by unauthorized access to your account resulting from your failure to maintain credential security.

3. Roles & Responsibilities

Organizers

Organizers create Camps and Tournaments, manage rosters, approve submissions, and receive funds raised. Organizers are solely responsible for the legality, ethics, and appropriateness of the challenges they choose, the supervision of participating minors, and the use of any funds raised.

Participants

Participants record and submit videos demonstrating completion of challenges. Participants are responsible for ensuring the safety of their activities. Participants must not record or upload content that could endanger themselves or others.

Supporters (Camps only)

Supporters voluntarily make donations to support Participants in Camp fundraisers. Donations are one-time payments processed through Stripe. See Section 5 for refund terms.

Joining Teams (Tournaments only)

Tournament events involve multiple teams from different organizations competing against each other. The Host Organizer creates the Tournament, pays the Tournament event launch fee, and sets a per-team Entry Fee. Each additional team that wants to compete pays that Entry Fee (paid by the joining team's organizer, not by individual players) through Stripe. How each joining team collects funds from its own members to cover the Entry Fee is the internal matter of that team and not facilitated by earn²keep. Tournaments use strict all-or-nothing scoring: a team earns points for a challenge only when every player on its roster completes it. See Section 5 for refund terms.

4. Fees

earn²keep charges only one fee:

Event launch fee: $149 per Camp; $249 per Tournament. Charged once at the time the Organizer activates an event. This is the entire fee earn²keep takes from the Organizer.
Transaction fees: None. earn²keep does not take any percentage or per-transaction cut of supporter donations, Tournament Entry Fees, or any other money flowing through events on the platform.

Card-processing fees charged by Stripe, Inc. (currently 2.9% + $0.30 per transaction) are deducted directly by Stripe and are not collected by earn²keep. These processing fees come out of the gross transaction amount before the recipient organization receives funds, and are disclosed transparently at the time of payment.

Fees are subject to change with notice. Existing events will be honored at the rate in effect at activation.

5. Payments & Refunds

All payments are processed by Stripe, Inc., subject to Stripe's terms of service.

Event launch fees

Refundable within 7 days of payment if no participants have been added to the event. After that, event launch fees are non-refundable.

Donations (Camps)

Donations to Camp events are refundable within 30 days of the original payment date for any reason, by emailing support@earn2keep.com with the payer's email and approximate date of payment. After 30 days, refunds are at our discretion, considered case-by-case (typically honored in cases of demonstrable fraud, misrepresentation, or platform error).

Tournament Entry Fees

Per-team Entry Fees paid by joining teams to participate in a Tournament are refundable up to 7 days before the Tournament's scheduled start date, by emailing support@earn2keep.com. Within 7 days of the start date, refunds are at the discretion of the Host Organizer (the organization that created the Tournament). If the Host Organizer cancels the Tournament at any point before its completion, all paid Entry Fees are automatically refunded to the joining teams, less Stripe's non-refundable card-processing fee described below.

Card-processing fees

Stripe's card-processing fee (currently 2.9% + $0.30 per transaction) is non-refundable and is charged by Stripe, not by earn²keep. earn²keep does not collect any percentage or per-transaction platform fee on donations or Entry Fees — only the flat event launch fee.

Marketplace model and prize payment responsibility

earn²keep operates as a marketplace platform connecting Organizers, Participants, Supporters, and Joining Teams. We facilitate payments and competition workflow, but earn²keep does not hold, custody, or distribute prize money. Each Host Organizer connects their own payment account, and supporter donations and Tournament Entry Fees settle directly to that account on the payment processor's standard schedule. The Organizer is the recipient and holder of funds.

For Tournaments: when a Tournament resolves, the winning team takes the pot. The Host Organizer is solely responsible for paying the winning team's organizer directly from their organization's bank account, by check, wire transfer, or any other method they arrange. earn²keep does not transfer prize funds, issue payouts to winners, or act as escrow.

For Camps: when an event completes, the Host Organizer is responsible for distributing configured prizes (gift cards or other rewards) to top-finishing Participants from the funds raised. earn²keep does not purchase, mail, or distribute prize gift cards.

Any dispute arising from prize payment — including non-payment, late payment, incorrect amount, or disagreement over winner selection — is between the Host Organizer and the recipient(s). earn²keep is not party to such disputes and bears no responsibility for prize payment by Host Organizers. Before participating in any Tournament or contributing to any Camp, users are encouraged to confirm directly with the Host Organizer how and when prize payments will be made.

6. User Content

You retain ownership of content you upload (videos, photos, text, challenge submissions). By uploading, you grant earn²keep a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process that content solely as necessary to provide the Service.

You represent and warrant that you own or have all necessary rights in any content you upload, and that the content does not violate third-party rights or applicable law. See our Acceptable Use Policy for details on prohibited content.

7. Prohibited Activities

You agree not to use the Service to:

Violate any law or regulation
Harm, threaten, or harass any person, especially minors
Misrepresent yourself or impersonate others
Submit fraudulent, manipulated, or AI-generated content as your own physical performance
Solicit funds for purposes other than those represented to supporters
Interfere with the operation or security of the Service
Scrape, reverse-engineer, or attempt to derive source code

Violation may result in immediate account suspension and forfeiture of any funds in escrow.

8. Termination

We may suspend or terminate your access at any time, with or without notice, for violation of these Terms or for any other reason in our sole discretion. You may terminate your account at any time by emailing support@earn2keep.com. Outstanding donations, registration fees, and event obligations survive termination.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. earn²keep DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, earn²keep'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE TOTAL FEES YOU PAID TO earn²keep IN THE 12 MONTHS PRECEDING THE CLAIM. earn²keep SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless earn²keep, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of [JURISDICTION TO BE SET], without regard to conflict-of-law principles. Any dispute will be resolved by [ARBITRATION CLAUSE / COURT VENUE TO BE SET BY COUNSEL].

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or via the Service. Continued use after such notice constitutes acceptance of the revised Terms.
